Avoid Registering “Subject to Writs” in Error

Let Teraview Do the Work

The best way to avoid receiving a “subject to writs” message is to refrain from manually entering writ of execution numbers.

By clicking on Retrieve Writs in the Transferor branch in Teraview, the system automatically “pre-populates” the correct writs number and debtor name into the Document. Manually entering a writ of execution number may cause you to register documents “subject to writs” when that is not your intention. This occurs when the writ of execution number you entered and the debtor name do not exactly match what was entered in the writs database.

The automatic writ search at registration will find the writ number but the debtor name will not match. As a result, the manually entered writ is replaced with the found writ and the correct debtor name is inserted as a new entry marked “subject to”.

A warning message will appear prior to registering.

Registration Warning Window

  3. Expand the party’s name and expand the Writs section.
  4. Verify that the correct writ of execution statement is selected from the drop-down menu.
  5. Sign the document and restart the registration process.

Avoid Registering “Subject to Writs” in Error

The best way to avoid receiving a “subject to writs” message is to refrain from manually entering writ of execution numbers. By retrieving a writ of execution from the Writs tab in the Teraview software, the system automatically “pre-populates” the correct writs number and debtor name into the document.

Let the Teraview software do the work for you — avoid manually entering data.  Manually entering a writ of execution number in the Writs No. field under the Writs tab with a debtor name that does not exactly match what was entered in the writs database may cause you to register documents “subject to writs” when that is not your intention. The automatic writ search at registration will find the writ number but the debtor name will not match. As a result, the manually entered writ is replaced with the found writ and the correct debtor name is inserted as a new entry marked “subject to”.

In this case, customers will see a warning message on their screen, immediately prior to registering.

The message says:

“The following instrument(s) are subject to writs: [document type/identification are inserted here]

If you see this warning, immediately take the following precautionary steps:

1. Cancel out of the registration by clicking the Cancel button.

2. Go to the Transferor Branch.

3. Highlight the party’s name.

4. Click on the Writs tab.

5. Ensure that the correct writ of execution statement is selected from the drop-down menu.

6. You can then start the registration process again.

Retrieve a writ of execution from the Writs tab and let the system pre-populate information for you.
