FIVE YEAR CLOSED PROVIDED that upon the death of the mortgagor or the mortgagor selling or disposing of the mortgaged lands and premises, or agreeing to sell or dispose of same, whether the conveyance or agreement be registered or not, the said principal sum together with interest to the date of maturity of the mortgage or any extension date thereof, shall immediately become due and payable, without any notice given or any action being taken by the mortgagee, and in default of payment, the mortgagee may exercise any of the remedies available hereunder to enforce payment, including the power of entering upon and leasing or selling the said lands. PROVIDED FURTHER that the mortgagee, upon the death or total and permanent disability of the mortgagor shall be at liberty to apply towards payment of the mortgage debt, monies received by it under any policy of group insurance carried by it on the lives of its borrowing member notwithstanding that the mortgage is not otherwise due. AND PROVIDED FURTHER that if the mortgagor ceases to be a member of the UKRAINIAN CREDIT UNION LIMITED, the mortgagee may, at any time, demand payment of the entire balance of the principal sum then owing hereunder, together with interest to the date of payment, upon giving the mortgagor three (3) months' notice in writing and upon the expiration of such three (3) months' notice, the balance of principal money owing hereunder, together with interest, shall immediately become due and payable, and in default of payment, the mortgagee may exercise any of the remedies available hereunder to enforce payment, including the powers of entering upon and leasing or selling the said lands. In addition to the conditions herein, the mortgagor shall have the privilege of paying the whole or any part of the outstanding principal balance on the date of maturity of this mortgage or any renewal date thereof. Upon payment, certified funds or cash must be received prior to 3:00 p.m. on a "Normal banking day". "Normal banking day" means: Any day except for Saturday, Sunday, statutory holiday, Ukrainian holiday, or holiday as designated by the Ukrainian Credit Union Limited from time to time. PROVIDED FURTHER that the mortgagor shall have the privilege of prepaying on account of original principal sum secured hereunder, without notice or bonus, annually on a non-cumulative basis on any anniversary of the Interest Adjustment Date an amount not exceeding twenty five percent (25%) of the original principal sum hereunder. PROVIDED FURTHER, without prejudice to any rights of the Mortgagee against the Mortgagor or any other persons liable for payment of the money hereby secured, this Mortgage may be extended by an agreement in writing on or before maturity for any term with or without an increased rate of interest notwithstanding that there may be subsequent encumbrances. And it shall not be necessary to register any such agreement in order to retain priority of this Mortgage so altered over any instrument registered subsequently to this mortgage. PROVIDED FURTHER that nothing herein confers a right of renewal upon the mortgagor.
